Malvern, PA (PRWEB) December 28, 2011
New findings from an Insurance Research Council (IRC) study of auto injury claim trends indicate that insurance claim costs countrywide have recently increased, reversing previous trends of declining or relatively stable costs. The report, Trends in Auto Injury Claims, 2011 Edition, documents important auto injury claim trends, both countrywide and by state, using private passenger auto claim data from national and state-level statistical reporting agencies.
Although injury claim severity (the average cost of injury claims) has been increasing steadily in the last several years, much of the increase has been offset by declining claim frequency, which produced relatively stable injury claim costs per insured vehicle. However, recent data indicate that claim frequency, on a countrywide basis, is no longer decreasing. In the case of personal injury protection (PIP) claims, the effect of rising claim severity has been magnified by a simultaneous increase in claim frequency. PIP claim costs per insured vehicle countrywide increased more than 18 percent from 2008 to 2010. For bodily injury (BI) liability claims, the effect of rising claim severity has been mitigated somewhat by stabilization, rather than an increase, in claim frequency. However, 2010 marks the first year since 1994 that BI claim frequency did not decline.
Much of the deterioration in PIP trends has been concentrated in three of the largest states with no-fault approaches to compensating auto injuries?Florida, Michigan, and New York. In Florida, the average PIP claim cost per insured vehicle in the state jumped 62 percent in just two years (2008-2010). PIP costs per vehicle in Michigan have been increasing rapidly for several years now?rising more than 120 percent over the last decade. The New York system has been on a roller coaster of rising and falling costs driven by a surge in suspected claim abuse in the New York City area.
?These are not encouraging findings for insurers or drivers,? said Elizabeth Sprinkel, senior vice president of The Institutes. ?While we hope these findings represent temporary conditions, we can?t be sure that is the case and can?t afford to ignore the factors driving rising claim costs.?
For more detailed information on the study?s methodology and findings, contact David Corum at (484) 831-9046, or by e-mail at irc@TheInstitutes.org. Copies of the study are available for $ 300 for an electronic version or $ 400 for a printed copy. Visit IRC?s Web site, http://www.insurance-research.org, for more information. The IRC recently published an in-depth analysis of PIP claims in New York, New York?s No-Fault System: Final Report on Closed Auto Injury Claims, which provides additional detailed information about recent trends and current conditions in New York?s automobile insurance system. The study is available now from the IRC Web site. A similar study of Michigan?s system will be published by IRC in early 2012.

New York?s recent ranking of automobile insurance companies — noting how many complaints had been submitted against them and how many were resolved in favor of consumers — is not only a commendable effort, but one that should be replicated by all other states, says Florida insurance attorney Patrick J. Tighe of X1LAW.com.
The New York report — ?2011 Annual Ranking of Automobile Insurance Complaints? — was published in December by that state?s Department of Financial Services. It ranks 179 automobile insurance companies that operate in New York, giving each a ?complaint ratio,? — the number of upheld complaints as a percentage of the insurer?s overall in-state private passenger auto insurance business. Insurers with the fewest upheld complaints per million dollars of premiums appear at the top of the list. Those with the highest complaint ratios are ranked at the bottom.
The results show that the biggest insurers in New York have much room for improvement in how they serve customers. The largest automobile insurer in the state, Geico General Insurance Company (an average of $ 1.28 billion in New York premiums for 2009 and 2010) ranked 66th, with 20 of 238 complaints to the Department of Financial Services upheld. The second largest auto insurer, Allstate Insurance Company (nearly $ 1.2 billion in premiums), fared even worse, at 130th, with 170 of 1,350 complaints upheld. Another well-known insurer receiving a middling score was State Farm Fire and Casualty Company, ranking 68th.
?This is exactly the kind of detailed, irrefutable data consumers need to see before they put their money — and perhaps their future — behind an automobile insurer,? says Tighe, who has been assisting Florida residents in insurance lawsuits and other claims for more than a decade. ?New York has always been among the most proactive and consumer-friendly of insurance regulators, and it?s time that Florida and other states follow its example. Letting consumers see which auto insurance companies are getting the most complaints, and which are having the most complaints against them upheld, is important step in enabling consumers to pick insurers that truly will protect them, and avoid those that may not.?
All states, says Tighe, have a department or agency that regulates insurers, yet most are relatively quiet, rarely, if ever, releasing detailed data on automobile insurance complaints, which include issues such as delays in the payment of no-fault or personal injury protection (PIP) claims, or insurers? failure to renew policies.
?New York is the exception to the rule,? says the veteran trial lawyer. ?They are consumer-focused, and they do it right. Their report gives you numbers you can rely on. Every insurance department in the country needs to the same.?
Ranking at the top of the New York list was the Erie Insurance Company, with 0 upheld complaints and $ 64 million in average annual premiums written directly in the state. The complete report is available online at http://www.dfs.ny.gov/insurance/auto/rank/auto2011.pdf.
?Insurance companies sell policies to consumers, hold their customers? money, and are supposed to use those funds to pay claims,? says Tighe. ?They are custodians and trustees of our money, which is why they are regulated. But that regulation needs to have some bite, and regulators need to be transparent. Because it is that transparency that keeps insurance companies honest — and keeps consumers protected.?
About X1Law P.A.
For over a decade, Florida personal injury and insurance lawyer Patrick J. Tighe has been protecting the rights of consumers, and those who have suffered catastrophic injury in automobile accidents, motorcycle accidents, and other life-changing events. In that time, he has represented — and come through for — thousands of individuals in insurance claims that were wrongly denied, delayed, or undervalued. Earlier in his career, Tighe spent nearly ten years working on ?the other side,? defending insurers in injury lawsuits. That experience gave him invaluable insight on how big insurers approach and handle insurance claim cases — insight that is leveraged every day to bring results, and justice, for clients.

The Oklahoma car accident lawyers at Atkins & Markoff hereby alert the public that members of the National Transportation Safety Board, or NTSB yesterday recommended at a meeting that legislatures enact a ban on the use of all cell phones in moving vehicles, including those who are using hands-free devices in order to bring down the number of auto accidents that occur because of inattentive drivers. The recommendation was published in an article that appeared in the Wall Street Journal.
Specifically, NTSB Chairperson Deborah A.P. Hersman stated that, ?It is time for all of us to stand up for safety by turning off electronic devices when driving.? She also cited statistics kept by the National Highway Traffic Safety Administration that revealed that an estimated 3,000 fatalities in car accidents that occurred last year could be traced to distracted drivers who were using cell phones to make phone calls and to send or receive text messages.
While the NTSB does not have legislative authority and the laws that are already in place in 35 states and the District of Columbia that limit the use of cell phones while driving are state laws, the board recommended federal action be considered in order to make the roads in the United States safer for all people.
Oklahoma car accidents occur at a high rate, and according to state statistics more than 70,000 auto accidents occur somewhere inside the state lines every year. These crashes lead to approximately 36,000 injuries and to more than 700 fatalities on an annual basis. Oklahoma is not currently one of the states that has enacted a specific cell phone law. Instead, the legislature in 2010 enacted House Bill 2276, which states in part that, ?The operator of every vehicle, while driving, shall devote their full time and attention to such driving.?
